Warranty & Terms of Sale
What our warranty covers, what voids it, what is excluded, how to claim, and the terms that apply to every estimate, order and invoice from Techni-Cope Systems.
THE SHORT VERSION
- 24 months on the components we supply and on our workmanship, from commissioning (complete systems) or delivery (packages), extendable to 5 years if arranged before the current warranty expires.
- You keep it by leaving the machine as we built it. Modifying the wiring or the system, disassembling or reverse-engineering it, or changing factory settings voids it.
- Wear items are not covered: bearings, torches and torch consumables, nozzles, electrodes, lenses, protective windows, fiber optic cables and the like.
- Water damage, weathering and corrosion are not covered.
- If something goes wrong, come to us first. You agree to use the warranty and service process to its full extent before taking legal action.
1. WHAT THESE TERMS COVER
These terms apply to every estimate, quote, order, invoice, delivery, installation, retrofit package, build-your-own package, software, part and service supplied by Techni-Cope, whether ordered through this website, by message, by phone or in person. Any term you propose that differs from these, including terms on a purchase order, does not apply unless we accept it in writing. If a written quote or invoice from us says something different from this page, the quote or invoice governs for that transaction.
2. ESTIMATES, QUOTES AND PRICES
- An estimate produced on this site is an indication of price, not an offer. It is valid for 30 days from its date. A quote or invoice from us is the offer; an order exists when we accept it in writing or when you pay the deposit or the invoice.
- Prices are in Canadian dollars before GST unless stated. GST and any other applicable tax are added. Prices for delivery outside Alberta, technician travel and special items are quoted for your location.
- Changes to length, options or plasma source before the build re-price the order. Changes after the build has started may be refused or may carry additional cost and time.
- We may correct an obvious error in an estimate, quote or invoice, and will tell you before proceeding.
3. PAYMENT, TITLE AND RISK
- Payment terms are set on the invoice. Where a deposit is required the build starts when it is received, and the deposit is not refundable once materials have been ordered or the build has started.
- Acceptance of an invoice is implied upon receipt of payment: by paying an invoice, in full or in part, you accept these terms and our Privacy Policy for that order.
- Overdue balances bear interest at 1.5% per month (19.56% per year), and we may withhold delivery, installation, software updates and support while an amount is overdue.
- Title to goods passes to you when we have been paid in full. Risk of loss passes to you on delivery, or, for a shipped package, when we hand it to the carrier. Until title passes you must keep the goods insured and must not sell or encumber them.
- Financing is offered on complete systems only, not on retrofit or build-your-own packages, and is arranged separately in writing.
4. DELIVERY, PICKUP, SHIPPING AND INSTALLATION
- Complete systems are picked up at our workshop by confirmed appointment, or delivered at the flat rate on the estimate, which includes the driver's help placing the machine and a technician's day of training. Build times on estimates are good-faith projections, not guarantees; delay does not entitle you to cancel or to damages.
- Retrofit and build-your-own packages are sold online and shipped; there is no pickup or delivery on them. The flat rate covers the electronics; rails and rack sets are drop-shipped from the supplier at their own rate; a supplied plasma source ships at its own rate. Installation by our technician is available on plate retrofits only, at the price on the estimate plus travel quoted for your location; it is not available for pipe builds or for any build using a gantry kit.
- You must inspect a delivery or shipment on receipt and report visible damage or shortages to us and to the carrier within 3 days. Concealed damage must be reported within 10 days of receipt.
- You are responsible for site preparation: a level floor able to carry the machine, the electrical service the machine needs (installed by a licensed electrician where your local code requires it), clean dry compressed air, ventilation or fume extraction, water for a water table, and safe access. A fiber laser also needs the air compressor, air dryer and any HVAC venting or extraction blowers, which are not included.
5. THE WARRANTY
5.1 What we promise
Techni-Cope warrants to the original purchaser that the components we supply, and our workmanship in assembling and installing them, will be free from defects in materials and workmanship under normal use for 24 months from commissioning of a complete system, or from delivery of a retrofit or build-your-own package (the “Warranty Period”). The Warranty Period may be extended, in one or more steps, up to a total of 5 years; an extension must be arranged and paid for before the current Warranty Period expires and may require an inspection.
5.2 Third-party equipment
A plasma source, fiber laser source, chiller, computer or other equipment made by another manufacturer carries that manufacturer's warranty, which we will help you claim. Our own warranty covers our integration of that equipment, not the equipment itself.
5.3 What we will do
If a covered defect appears during the Warranty Period and you report it as described in section 8, we will, at our option, repair the part, replace it with a new or reconditioned equivalent, or refund the price paid for that part. Replacement parts are shipped to you at our cost within Canada and carry the remainder of the original Warranty Period. Labour and technician travel are included for a defect that appears in the first 12 months of a complete system we installed; after that, and for all retrofit and build-your-own packages, labour and travel are charged at our then-current rates while parts remain covered. Remote support by phone, message and video is included throughout the Warranty Period.
6. WHAT VOIDS THE WARRANTY
The warranty is void, in whole or for the affected part at our reasonable determination, if:
- the wiring is modified, extended, re-routed, spliced or replaced by anyone other than Techni-Cope, other than plugging and unplugging the connectors we supplied for that purpose;
- the system is modified: components added, removed, substituted or altered, including motors, drives, the Z axis, sensors, the control box, the controller, the torch height control, mounts or the frame we supplied;
- the machine, its control box, controller or software is disassembled, decompiled, reverse-engineered, copied, probed or otherwise examined beyond the normal maintenance described in the GUIDE;
- factory settings are changed: drive, motor, sensor, torch, machine-geometry, safety or software parameters, protected files or firmware, or a password-protected or service-only setting is accessed or altered;
- the machine is repaired, serviced or installed by anyone we have not authorised, or non-genuine or unsuitable parts or consumables are fitted;
- the machine is used outside its stated capacity or specification, with an unsuitable power supply, without the compressed air, extraction or water it needs, or in a way contrary to the GUIDE, safe practice or applicable law;
- the machine is neglected: not maintained as the GUIDE describes, run with contaminated air or water, run with worn consumables, or left dirty in a way that damages it;
- the damage results from an accident, misuse, abuse, overloading, a crash the crash-detection could not prevent because it was disabled or bypassed, fire, flood, lightning, power surge, electrical fault in your supply, or any other cause outside the machine;
- the serial number, label or seal on a component is removed, altered or defaced; or
- the machine is sold or transferred to another party, unless we have agreed in writing to transfer the warranty.
7. WHAT IS NOT COVERED
- Consumables and wear items, which are expected to wear out with use and are excluded regardless of when they fail: bearings, linear guide blocks and rollers, drive gears, racks and pinions where wear is the cause, belts, torches and torch bodies, torch leads, nozzles, electrodes, swirl rings, retaining caps, shields, protective windows, ceramic parts, lenses, mirrors and other optics, fiber optic cables and their connectors, cutting nozzles, filters, seals, hoses, fluids, fuses, lamps, water-table components exposed to cut material, and any other part identified in the GUIDE as a wear item. Looked after, bearings and torches last years; neglected, they can fail in under six months.
- Water damage, weathering and corrosion: damage from water, coolant, condensation, humidity, rain, snow, flooding, salt, chemicals, dust in the environment beyond normal shop conditions, sun, freezing or any other environmental exposure, including a machine stored or used outdoors, in an unheated space where condensation forms, or in a wet area not designed for it. A water table is designed to hold water in its bed; water anywhere else on the machine is not covered.
- Cosmetic damage, scratches, paint, discolouration and marks that do not affect function.
- Cut quality, which depends on material, consumables, settings, air quality, alignment and operator skill, and is not a defect.
- Your frame, gantry, table or rails on a retrofit or build-your-own package, their alignment, squareness and rigidity, and any consequence of them. The gantry kit is electronically plug and play; mounting and aligning the rails and gear rack is your responsibility and the machine performs as well as that alignment.
- Software features not described in the GUIDE at the time of sale, compatibility with third-party software or files, and anything arising from files, designs or DXF you import.
- Normal adjustments, calibration and maintenance, and consumables used in a warranty repair.
- Anything excluded under section 6.
8. HOW TO CLAIM
- Stop using the affected function and contact us through the messages in your account, by requesting a call at techni-cope.app, or by writing to our billing address, within 14 days of noticing the problem. Give the estimate or invoice number, a description, and photos or video.
- Work with our technician on remote diagnosis first; most problems are resolved this way. Follow the steps we give you and do not attempt a repair we have not authorised.
- If a part must come back to us, we will tell you how to pack and ship it. We may ask for the part before sending a replacement, or ship a replacement against a deposit.
- If we find the part is not defective, or the failure falls under section 6 or 7, the diagnosis, parts, labour, travel and shipping are chargeable at our then-current rates.
9. DISCLAIMER OF OTHER WARRANTIES
The warranty in section 5 is the only warranty we give. To the fullest extent permitted by law, all other warranties, conditions and representations, express or implied, statutory or otherwise, including any implied condition or warranty of merchantability, merchantable quality, fitness for a particular purpose, durability, non-infringement, or arising from a course of dealing or usage of trade, are excluded, including those implied by the Sale of Goods Act (Alberta). If you are a consumer under the Consumer Protection Act (Alberta) or another law that does not allow such exclusions, they apply to you only to the extent that law permits, and nothing here limits a right you have under that law.
10. LIMITATION OF LIABILITY
- To the fullest extent permitted by law, Techni-Cope, 2656560 Alberta Corp and their directors, officers, employees, contractors and suppliers are not liable to you or to anyone claiming through you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, production, business, contracts, data, goodwill or anticipated savings, or for downtime, scrapped material, cost of substitute equipment or cover, however caused, whether in contract, tort (including negligence), under statute or otherwise, even if advised of the possibility.
- Our total liability for any and all claims arising out of or relating to a product or service is limited to the amount you paid us for that product or service.
- Plasma and laser cutting are hazardous. You are responsible for safe installation, guarding, ventilation, fire prevention, eye and skin protection, electrical safety, training and supervision of operators, and for compliance with Alberta's Occupational Health and Safety Act and every other law that applies to your workplace. We are not liable for injury, death or property damage arising from the operation of a machine except to the extent caused by our proven negligence and not excluded by law.
- You will indemnify Techni-Cope against claims by third parties arising from your use, modification, resale or operation of a product, or from your breach of these terms.
11. SOFTWARE, INTELLECTUAL PROPERTY AND CONFIDENTIALITY
- The Techni-Cope software on the touch-screen controller, the simulator, COPE CREATE, PLATE CREATE, the GUIDE, the job-costing tools, drawings, documentation, designs and the Techni-Cope name and marks are the property of Techni-Cope or its licensors and are protected by copyright, trademark and trade-secret law.
- Software is licensed, not sold. You receive a non-exclusive, non-transferable licence to run the software on the machine it was supplied with, for operating that machine. You may not copy, distribute, sublicense, rent, modify, translate, decompile, disassemble, reverse-engineer, extract, probe the storage of, or create derivative works from the software, firmware or controller, or remove or defeat any protection, licence check, marriage of the software to its hardware, or update mechanism, except to the extent a law that cannot be contracted out of allows.
- The simulator on this site is provided for evaluation only and no licence is granted to copy or reuse any part of it.
- The design, construction and settings of the machine and its packages are confidential and proprietary. You will not disclose them to a competitor, use them to build or have built a competing product, or allow another party to examine the machine for that purpose.
- Any breach of this section voids the warranty and entitles us to injunctive relief in addition to any other remedy.
12. DISPUTES: WARRANTY AND SERVICE FIRST
- If you are dissatisfied with a product or service, you agree to bring the matter to us first and to use our warranty and service process to its full extent, including remote diagnosis, repair, replacement and any escalation we offer, and to give us a reasonable opportunity to put it right, before commencing any legal action or chargeback. Nothing in this clause prevents a complaint to a regulator or a privacy commissioner where the law allows it.
- Where a dispute cannot be resolved between us within 60 days of you raising it, either party may propose mediation in Alberta before any court proceeding, and the parties will consider it in good faith.
13. RETURNS AND CANCELLATION
- Complete systems and retrofit or build-your-own packages are configured and built or assembled to order and are not returnable except under the warranty. An order may be cancelled only with our written agreement, and any deposit, materials ordered, work done and restocking are chargeable.
- An unopened, unused stock item may be returned within 14 days of receipt with our prior agreement, at your shipping cost, less a 15% restocking charge.
14. GENERAL
- Governing law. These terms and every transaction under them are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. The courts of Alberta have exclusive jurisdiction, and you attorn to them, subject to section 12.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including supplier delays, carrier delays, shortages, strikes, weather, fire, flood, pandemic, government action or utility failure.
- Entire agreement. These terms, our Privacy Policy, and the estimate, quote or invoice for the transaction are the entire agreement and replace every earlier discussion or representation. No verbal promise binds us unless it is written into the quote or invoice.
- Severability and waiver. If a part of these terms is held unenforceable, the rest remains in force and the part is read as narrowly as needed to be enforceable. A failure to enforce a term is not a waiver of it.
- Assignment. You may not assign an order or the warranty without our written consent. We may assign our rights to a successor of the business.
- Survival. Sections 3, 6, 7, 9, 10, 11, 12 and 14 survive delivery, completion, cancellation or expiry of the warranty.
- Changes. We may update these terms. The version date at the top changes when we do, and the version you accepted is recorded with your estimate or account; the version in force when you paid an invoice governs that order.
- Language. The parties have required that these terms be drawn up in English.
